The past year has seen some significant changes in the law and general business climate affecting IP practice and strategy.
The America Invents Act is altering the landscape for patent prosecution and strategy.
In the online world copyright battles have been played out around the globe regarding contributory liability with differing outcomes.
Trolling has extended beyond patent enforcement into copyright enforcement (at this stage without much success).
In the high tech industries we are seeing an increased tendency to amass patents as artillery. On the other hand Twitter created ripples of shock when it announced its plans not to use assigned patents offensively without prior consent from the inventor.
Considerable uncertainty remains regarding gene patenting in the US.
I’m sure the year ahead will hold many more changes affecting IP practice and strategy.
